EU: DuPont Wins Flusilazole Case
The inclusion of the product was valid for an 18 month period, rather than the usual 10 year period, and and restricted the use of flusilazole-based products to certain crops. These decisions were challenged in court, as the EU did not list valid reasons for the restrictions, according to DuPont.
Tthe European Court of First Instance responded agreed with DuPont’s position and has issued an interim order on 19 July suspending the restrictions. Flusilazole is now listed in Annex I with no limitations on its period of validity or the number of crops on which the product can be authorized.
